The Products purchased from shop.majani.com are sold directly by Majani 1796 Spa, hereinafter referred to as the “Vendor”.
Majani 1796 Spa is a company recorded on the Bologna Companies Register, Tax Code and VAT No. 02691991208, with registered offices at Via G.Brodolini n. 16 – Loc. Crespellano – 40053 VALSAMOGGIA (BO), Capital Stock Euro 5,000,000.00 fully paid.

1. Our commercial policy

The Vendor offers the Products for sale via shop.majani.com and carries on its B2C e-commerce activities solely in relation to its “consumer” end users.

1.2
A Consumer is defined as any real person who, accepting these General Conditions, purchases one or more Products from the on-line store for purposes unrelated to their own commercial activities.

1.3
In view of its commercial policy, the Vendor reserves the right to refuse orders received from parties other than “consumers” and those that are not properly prepared in accordance with these General Conditions of Sale.

1.4
These General Conditions of Sale govern solely the offer, submission and acceptance of orders between the users of shop.majani.com and the Vendor.

2. Completion of a contract with the Vendor

In order to complete a contract for the purchase of one or more Products from shop.majani.com, you must complete the electronic order form and submit it electronically to the Vendor, following the instructions provided.

The order form contains summary information about the essential characteristics of each Product ordered and its price (including all applicable taxes), as well as the payment and delivery methods available for purchased Products, the related shipping and delivery costs, the conditions for exercising the right to withdraw, and the methods and deadline for the return of purchased Products.

The contract is completed on receipt by the Vendor of the electronic order form, subject to checking the accuracy of the data contained in the order concerned.

You will be requested to read the General Conditions of Sale carefully, before purchasing any Products.

The order form will be held in our database for the period of time needed to fulfill the order and, in all cases, for the time period required by law. You may view your order form in the private area, using your access codes.

2.6
The Vendor may refuse your purchase orders if the payment guarantees are insufficient, if they are incomplete or incorrect, or if the Products are unavailable. In such cases, we will inform you by e-mail that the contract has not been completed and that the Vendor has refused your purchase order, specifying the related reasons. If the Products present in shop.majani.com are no longer available or on sale at the time of your latest visit to the website or of submitting the order form, the Vendor will arrange to inform you about the non-availability of the Products ordered within thirty (30) days of the day following submission of your order to the Vendor. In this case, if the order form is submitted and the price paid, the Vendor will arrange to reimburse the amount already advanced by you.

Electronic submission of the order form represents your unconditional acceptance of and agreement to comply with these General Conditions of Sale in your relations with the Vendor. If you do not agree with any of the clauses contained in these General Conditions of Sale, please do not submit an order form for the purchase of Products from shop.majani.com.

By submitting the order form, you confirm your knowledge and acceptance of these General Conditions of Sale and the additional information contained in shop.majani.com, whether directly or by link, including the General Conditions of Use, the Privacy Policy and the information about the Right to Withdraw.

On completion of the contract, the Vendor will send you an e-mail purchase order receipt summarizing the information already stated on the order form.

3. Warranties and information about Product prices

The essential characteristics of each Product are presented on their individual information pages within shop.majani.com. The images and colors of the Products offered for sale on shop.majani.com might however not correspond with reality, depending on the Internet browser and monitor used.

3.2
The Vendor does not sell used, non-conforming or lower quality Products with respect to the corresponding standard products available on the market.

3.3
If you exercise your right to withdraw, the Vendor is entitled to refuse the return of Products whose essential and qualitative characteristics have been altered, or which have been damaged.

3.4
The prices of the Products are subject to change. Please check the final selling price before submitting the related order form.

3.5
Purchase requests received from countries not included in the country selection list cannot be accepted by the Vendor.

4. Payment

Prices are stated inclusive of VAT, packaging and packing materials.

4.2
In order to pay for the Products and the related delivery expenses, please use one of the methods indicated on the order form.

4.3
If you pay by credit card, the related financial information (e.g. credit/debit card number and expiry date) will be encrypted and sent to Banca Sella or other banks that provide remote electronic payment services, without any possibility that third parties might gain access to it.
In addition, such information will never be used by the Vendor, except to complete your purchase transaction or make repayments should you exercise your right to withdraw and return the Products, or if necessary to prevent or report to the police any fraudulent activity on shop.majani.com.
The price for the purchase of Products and the related delivery expenses will be charged to your current account when the purchased Products are shipped.

5. Shipment and delivery of Products

7. Right to withdraw
7.1
You are entitled to withdraw from the contract completed with the Vendor, without penalty and without giving any reason, upon notifying the Vendor within ten (10) working days of the date of receipt of the Products purchased from shop.majani.com.

7.2
In order to withdraw from the contract, you must specify the Products purchased, the related order number and your personal details, so that the amount paid can be credited directly to the credit card used for the purchase. You must also return the Products to the Vendor, which must receive them within ten (10) working days of the date they were received by you.

7.3
The shipping expenses incurred for the original delivery of the Products purchased will not be reimbursed. On the other hand, there is no charge for the return shipment if you use our transport company. If you decide to use a different transport company, you will bear the return shipping costs.

7.4
In addition to the conditions specified above, the right to withdraw is also subject to the following conditions:

• The shipping document must be completed properly;
• The right to withdraw only applies to goods that are complete at the time of return;
• The Products must not have been used, modified or damaged;
• The Products must be returned to the Vendor in one shipment;
• The Products must be returned in their original packaging;
• The Vendor must receive the returned Products within ten (10) working days of the date on which they were received.

7.5
If the right to withdraw is exercised in accordance with the above conditions, the Vendor will arrange to reimburse the customer for the full amount collected for the purchase of the Products, within 30 days of the date on which the Vendor becomes aware of the exercise of your right to withdraw.

7.6
If the methods and deadlines for exercising the right to withdraw are not respected, you will not be entitled to repayment of the amounts already paid to the Vendor; however, you will be able to receive back the Products, at your expense, in the state in which they were returned to the Vendor. Failing this, the Vendor may retain both the Products and the amounts already paid for their purchase.

7.7
You may not return Products that, in accordance with your specifications, have been personalized with your name or logo.

8. Timing and methods of repayment
8.1
Following the return of the Products, the Vendor will perform the necessary checks on their conformity with the terms and conditions indicated in clause 7. If the outcome of such checks is positive, the Vendor will send you e-mail confirmation of acceptance of the returned Products.

10. Applicable law and resolution of disputes

These General Conditions of Sale are governed by Italian law and, in particular, by Decree no. 206 dated September 6, 2005, and subsequent amendments and additions, covering the consumer code including, specifically, the regulations on distance sales contracts, as well as by Decree no. 70 dated April 9, 2003, covering certain aspects of e-commerce.

10.2
All disputes arising under this contract, for which the Parties intend to make recourse to the judiciary, shall be referred to the sole jurisdiction of the Bologna Court.

11. Amendments and updates
11.1
These General Conditions of Sale are amended from time to time, not least to take account of any legislative changes. The new General Conditions of Sale will take effect from the date of their publication on shop.majani.com.
